For what purpose we process your personal data

At JOPPY we process the information provided by users / data subjects in order to manage our employment matching platform to connect companies and tech candidates.

We also process data for sending our newsletters.

We do not carry out profiling, as it is the candidate who registers their own, nor do we make automated decisions based on the data provided.

For candidates we process identification and contact data, as well as any other data the candidate wishes to provide to create their profile. The candidate decides whether to anonymise their profile or make it public on the platform.

For companies, we process the data of contact persons and/or their legal representatives for the purpose of managing the provision of contracted services.

How long we will retain your data

The personal data provided will be retained for as long as necessary for the provision of the contracted service, until the data subject requests their erasure, and for the legally established periods.

What is the legal basis for processing your data

The legal basis for processing your data will be, as the case may be, the data subject's consent, the performance of a contract, or legitimate interest.

The processing of candidate data is based on the data subject's consent given through the means provided for this purpose on the website or app. The anonymisation of a candidate’s profile or the disclosure of their personal data is only carried out under the candidate's express consent.

The processing of data of contact persons and/or legal representatives of hiring companies is based on the performance of the contract entered into between the parties and the legitimate interest of maintaining the established commercial relationship.

The processing of data for sending newsletters is based either on our legitimate interest under the GDPR and Spanish Law 34/2002 (LSSI-CE), or on your consent when you explicitly opt in to receiving our communications. We will always offer you the possibility to exercise your right to object to such processing through our messages.

Who we share your data with

Anonymous candidate profiles may be disclosed to third-party companies not registered on JOPPY that are interested in filling certain vacancies. Disclosure of contact data to third-party companies will only take place with the candidate's express consent.

We will not disclose your data to third parties except where legally required.

Data processors and international data transfers

For the provision of our services we may use external technology providers that act as data processors, some of which are located or may store data outside the European Economic Area.

Specifically, we use, among others, the following services:

  • Google (Google LLC / Google Ireland Limited), for authentication, messaging and application notification services. Main processing location: EU and, where applicable, USA, as described in their privacy policy.
  • Amplitude (Amplitude, Inc.), for platform usage analytics and user behaviour measurement.
  • ActiveCampaign, LLC, as a communications automation and user database management platform.
  • SendGrid (Twilio, Inc.), for sending transactional emails and service-related communications.

International data transfers that may be made in connection with the use of these providers are based on:

  • European Commission adequacy decisions, when the third country or international organisation has been declared to have an adequate level of protection in accordance with Article 45 GDPR.
  • In the absence of an adequacy decision, Standard Contractual Clauses approved by the European Commission (Art. 46 GDPR and Implementing Decision (EU) 2021/914), together with the application of additional technical and organisational measures where necessary (encryption, access controls, activity logging, etc.).

All our providers are bound by data processor contracts that include the guarantees required by Articles 28 and 46 of the GDPR.

How we obtained your data

Data for both groups, companies and candidates, comes directly from the data subject and from LinkedIn.

What are your rights when you provide us with your data

Any person has the right to obtain information as to whether JOPPY is processing personal data concerning them or not.

Data subjects have the right to access their personal data, as well as to request the rectification of inaccurate data or, where applicable, to request their erasure when, among other reasons, the data are no longer necessary for the purposes for which they were collected. They also have the right to data portability.

In certain circumstances, data subjects may request restriction of processing of their data, in which case we will only retain the data for the exercise or defence of legal claims.

In certain circumstances and for reasons related to their particular situation, data subjects may object to the processing of their data. In such cases, JOPPY will cease to process the data, except for compelling legitimate grounds or for the exercise or defence of legal claims.

You may exercise your rights by sending an email to [email protected] duly identifying yourself and expressly stating which specific right you wish to exercise.

If you have given your consent for a specific purpose, you have the right to withdraw the consent given at any time, without affecting the lawfulness of processing based on consent before its withdrawal.

If you feel that your rights regarding the protection of your personal data have been infringed, especially when you have not obtained satisfaction in the exercise of your rights, you may contact the Data Protection Officer, if one has been appointed, or lodge a complaint with the competent Data Protection Supervisory Authority through its website: www.aepd.es

Further information on the processing of your data

When we need to obtain information from you, we will always ask you to provide it voluntarily by giving your consent expressly through the means enabled for this purpose.

The processing of data collected through the website data collection forms or other channels will be included in the Record of Processing Activities for which JOPPY is responsible.

JOPPY processes data confidentially and adopts the appropriate technical and organisational measures to ensure an adequate level of security for the processing, in compliance with the requirements of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 and other applicable data protection legislation.

However, JOPPY cannot guarantee the absolute invulnerability of its systems; therefore, it assumes no responsibility for damages arising from alterations that third parties may cause to computer systems, electronic documents or user files.

If you leave our website via links to websites that do not belong to our organisation, JOPPY is not responsible for the privacy policies of such websites or for the cookies they may store on the user's computer.
